General conditions
1. Acceptance of the general conditions
1.1 The present general and special conditions of sale apply to all contracts and apply to both consumers and traders.
1.2 These terms and conditions are published on the hotel website. By this fact, the clients, co-contractors and all third parties agree to be bound by these general and special terms and conditions, to have read them and to have accepted all their provisions, unless expressly agreed otherwise.
1.3 Clients, co-contractors and third parties expressly agree that the present terms and conditions shall apply to all future transactions, irrespective of renewed written confirmation, and more particularly to agreements concluded verbally, by telephone, telex, fax, e-mail or any other electronic means.
1.4 Conditions deviating from these conditions, which have not been expressly accepted by Brasserie - Logies 't Ponton in writing and in advance, have no legal force vis-à-vis Brasserie - Logies 't Ponton, even if not expressly contested.
1.5 The annulment of an article or a clause never entails the nullity of the whole of the general conditions.
2. Quotations and orders
2.1 The quotations drawn up by Brasserie - Logies 't Ponton are without obligation, unless expressly agreed otherwise. A reservation is only considered final when the client receives a confirmation of reservation.
2.2 Any quotation or offer made by Brasserie - Logies 't Ponton may be withdrawn by Brasserie - Logies 't Ponton until the knowledge of the written acceptance by the client, the co-contracting party or the third party and expires automatically 10 days after the date, unless another period is indicated on the quotation or offer.
2.3 All bookings bind the clients, co-contractors and third parties, but bind Brasserie - Logies 't Ponton only after written confirmation and payment of the requested amount.
2.4 All bookings are binding on the clients, co-contractors and third parties, but only bind Brasserie - Logies 't Ponton in writing and after payment of the amount due.
3. General provisions
3.1 Brasserie - Logies 't Ponton is allowed to transfer all rights resulting from any agreement to a third party.
3.2 The client, co-contracting party or third party undertakes, if applicable, not to remove publicity displayed by Brasserie - Logies 't Ponton.
3.3 Force majeure, strike, lock-out ... or any other unforeseeable event preventing Brasserie - Logies 't Ponton from duly executing the agreement, is expressly accepted as a valid reason for termination of the agreement, without being liable for any compensation.
3.4 All services and performances of Brasserie - Logies 't Ponton are in any case to be considered as obligations of means and can never be considered as an obligation of result.
4. Price
4.1 The agreed price applies only during the agreed period of price fixing.
5. Terms of payment and invoicing
5.1 All bills, invoices or hotel notes of Brasserie - Logies 't Ponton are always payable in cash and without discount upon leaving the hotel.
5.2 The exceptional granting of any other means of payment can only be done in writing and can never entail novation, modification or abolition of the general conditions of Brasserie - Logies 't Ponton.
6. Acceptance of the invoice
6.1 No complaint against the invoices of Brasserie - Logies 't Ponton will be accepted if it is not made by registered mail within 10 calendar days after invoice date. Payment of the price always implies acceptance of the bills, invoices or hotel notes.
7. Non-payment
7.1 If payment is not received by Brasserie - Logies 't Ponton within 14 calendar days (both domestic and foreign) of the invoice date, default interest of 12 % per annum will be due ipso jure, and without prior warning or notice of default, from the invoice date.
7.2 The amount of the invoices remaining unpaid within 14 calendar days of the invoice date will be increased, as damages, by operation of law, by 10% with a minimum of 100 euro to compensate Brasserie - Logies 't Ponton for all its extrajudicial expenses, loss of time, administration costs and correspondence. The compensation will be due without prior notice and without prejudice to the principal sum, interests and possible legal costs.
7.3 In the absence of receipt by Brasserie - Logies 't Ponton of the cash payment of a single invoice within 30 calendar days of the invoice date, all invoices will automatically become payable immediately.
7.4 Furthermore, Brasserie - Logies 't Ponton will not be obliged to carry out further deliveries or services under any agreement before the past due invoices have been settled.
8. Annuleringsvoorwaarden
8.1 Onderstaand treft u de voorwaarden aan die bij annulering van kracht zijn. De getoonde bedragen en percentages dienen door u te worden betaald.
- Bij annulatie binnen 14 dagen voor aankomstdatum betaald u de eerste nacht.
- Bij annulatie binnen 7 dagen betaald u het volledige verblijf
9. Check-in, check-out
9.1 De Klant kan inchecken in het hotel vanaf 16 uur. Het uitchecken dient te gebeuren voor 11 uur. Indien de klant laattijdig opdaagt, behoudt Brasserie – Logies ‘t Ponton zich het recht voor om de desbetreffende reservering te annuleren (zie voorgaand punt, 8. Annuleringsvoorwaarden).
Indien de klant laattijdig uitcheckt behoudt Brasserie – Logies ‘t Ponton zich het recht voor om een extra dag of een supplement aan te rekenen aan de op dat ogenblik geldende tarieven.
10. Schade en aansprakelijkheid
10.1 Alle schade dewelke door cliënten, medecontractanten of derden aan de hotels wordt aangebracht zal op kosten van de cliënten, medecontractanten of derden worden hersteld. Ook winstderving waarvan de aangebrachte schade de oorzaak zou zijn, kan in rekening worden gebracht (kamer 1 of meer dagen niet verhuurbaar). Het minimumbedrag bij aangebrachte schade bedraagt €150,00.
11. Retentierecht
11.1 Brasserie – Logies ‘t Ponton heeft het recht om op basis van alle vervallen aanspraken die haar rechtens de overeenkomst en huidige voorwaarden toekomen, een retentierecht uit te oefenen op de goederen of andere waarden die in haar bezit zijn en deze als waarborg te beschouwen tot zekerheid van het nakomen van de verbintenissen waartoe de cliënt, de medecontractant of de derde gehouden is.
11.2 De goederen die aan Brasserie – Logies ‘t Ponton worden toevertrouwd, worden geacht deel uit te maken van een en dezelfde ondeelbare overeenkomst zelfs wanneer deze overeenkomst in opeenvolgende prestaties wordt uitgevoerd.
11.3 De bovenstaande bepalingen gelden onverminderd andere zekerheden waarop Brasserie – Logies ‘t Ponton zich volgens de wet of enige overeenkomst kan beroepen.
12. Persoonlijke levenssfeer
12.1 Uw persoonlijke gegevens vermeld op documenten van Brasserie – Logies ‘t Ponton worden opgenomen in de bestanden van Brasserie – Logies ‘t Ponton en zijn bestemd voor intern gebruik, facturatie, klantenbeheer, evenals voor promotie-acties, marktstudies en informatieverstrekking allerhande.
12.2 Op schriftelijk verzoek en overeenkomstig de wet van 8 december 1992 heeft de koper een inzage- en verbeteringsrecht.
13. Jurisdictie
13.1 Deze Algemene Voorwaarden zijn onderworpen aan het Belgisch Recht. Bij eventuele geschillen is uitsluitend de rechtbank van Veurne bevoegd.
La Brasserie - Logies 't Ponton est autorisée à céder à un tiers tous les droits résultant de tout contrat.Le client, le cocontractant ou le tiers s'engage, le cas échéant, à ne pas supprimer la publicité affichée par la Brasserie - Logies 't Ponton.
